Moonis requests SC for early hearing of review plea

ISLAMABAD: Moonis Elahi, central leader of the Pakistan Muslim League-Quaid (PML-Q), has filed an application in the Supreme Court for early hearing of his review petition against the court’s August 8 verdict of reassigning investigation into the National Insurance Company Limited (NICL) scandal to Federal Investigation Agency (FIA) Additional Director General Zafar Qureshi.
Senator Babar Awan on Monday moved the application on behalf of Moonis, one of the main accused in the NICL scandal, requesting the court to fix the hearing of his review petition on September 9.
He contended that if the review petition along with stay application was not heard at an early date, the petitioner shall suffer an irreparable loss and injury to his person as well as reputation because hearing of these matters after the completion of wrongful, biased, incorrect and inimical investigation would render the pendency of these matters before this court infructuous and thus the ends of justice would be frustrated.
“The petitioner, who is behind the bars, has been condemned unheard. No opportunity of hearing was given to him before passing the order on August 8. The principle of audi alterem partem has been violated in the instant case. Reliance is placed on Zahida Sattar’s case [PLD 2002 SC page 408]”, Babar Awan further stated.
He also mentioned that the petitioner had been adversely affected from the impugned order as the investigation of his cases had been entrusted to a person who was biased against the petitioner and his family on personal grounds as well as for political reasons.
He said that Zafar Qureshi wanted to complete the investigation expeditiously without giving notice to the petitioner or affording him an opportunity of bringing on record the true circumstances as well as specific grievances against so-called investigator who had proclaimed enmity against the petitioner fearing death, therefore, order under review was patently illegal and unconstitutional.
